Acceptable Use Policy

Introduction

This Acceptable Use Policy (“Policy”) regulates the utilization of the Hosting Services provided by BroccoliHost. By using these services, you acknowledge and agree to comply with all the policies outlined herein, supplementing our terms and conditions. Please note that BroccoliHost reserves the right to modify this Policy without prior notice.

Resource Usage

  • Shared Hosting Services Description: The Shared Hosting Services provide web space on our servers, enabling you to upload pages and files for website publication purposes.
  • Server Space Allocation:
    • Some Hosting Services offer ‘unlimited’ server space for regular, non-file-distribution web usage.
    • For websites allowing downloading of video, audio, or other files, we retain the right to impose a bandwidth limit of 250 gigabytes per calendar month.
  • Non-File-Distribution Usage: Usage excluding file distribution remains unaffected by download limits imposed on video, audio, or other files.
  • Prohibited Actions:
    • While using the Shared Hosting Services (except for instances involving your own virtual private server), the following actions are prohibited:
      • Using more than 10% of our platform’s processing capacity. Activities leading to this include, but are not limited to, CGI scripts, intensive FTP, PHP, or HTTP operations.
      • Running stand-alone, unattended server-side processes or any daemons (including IRCd).
      • Running web spiders or indexers.
      • Running software that interfaces with an Internet Relay Chat network.
      • Running bit torrent applications, trackers, or clients. Legal torrent file linking off-site is permissible, but hosting or storing them on our servers is prohibited.
      • Participating in any file-sharing/peer-to-peer activities.
      • Running gaming servers.
      • Running entries or scheduled tasks outside of configuring them through our control panel.
      • Providing web space under a domain for free.
      • Operating a proxy website or service.
      • Acting as a remote file host for other websites.
      • Operating self-hosted file sync or similar cloud storage-based services (e.g., OwnCloud, Pydio, Sparkleshare).
  • Offsite Backup Restriction:
    • Hosting Services are not to be used as offsite backup facilities. All files uploaded must be web-visible unless they are essential for the functioning of the associated website. Non-web-visible files or directories may be deleted without notice.
  • Search Engine Accessibility:
    • All website pages stored on our servers as part of the Hosting Services will be accessible to search engines unless you opt to prevent this. Optimizing web pages for search engines obligates compliance with guidelines issued by major search engines such as Google, Bing, and Yahoo.
  • MySQL Database Limitation:
    • MySQL Databases are limited to 1024 megabytes. Upon reaching this size, we will notify you.
  • Account Deactivation
    • We reserve the right to terminate an account which has been deactivated for more than 30 days.

Prohibited Uses

  • Lawful Use Requirement:
    • You are permitted to use the Hosting Services solely for lawful purposes. Prohibited actions include:
      • Breaching any local, national, or international laws or regulations.
      • Engaging in any unlawful or fraudulent activities or having any unlawful or fraudulent intent or impact.
      • Using the Hosting Services with the intent to harm or cause harm to minors.
      • Infringing our content standards (refer below).
      • Transmitting or soliciting unsolicited or unauthorized advertising, promotional material, or any form of similar solicitation (also known as SPAM).
      • Knowingly transmitting any data, sending, or uploading materials containing harmful elements such as viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other damaging computer code intended to negatively affect the operation of any computer software or hardware.

Content Standards

  • Application:
    • These content standards pertain to all materials hosted through the Hosting Services and any associated interactive services.
    • Compliance with the spirit of these standards is mandatory for each part and entirety of any Material.
  • Material Requirements:
    • Material must:
      • Be factually accurate where stating facts.
      • Reflect genuinely held opinions where expressing opinions.
      • Comply with applicable laws in the UK and any country from which they are posted.
  • Material Restrictions:
    • Material must not contain or promote:
      • Any defamatory content towards any individual.
      • Material that is obscene, offensive, hateful, or inflammatory.
      • Pornographic material.
      • Content advocating violence or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
      • Infringement upon any copyright, database right, or trademark belonging to others.
      • Deceptive content likely to mislead.
      • Material created in breach of legal duties owed to a third party, including contractual obligations or confidentiality.
      • Any promotion of illegal activities.
      • Threatening, abusive, invasive, or harassing content.
      • Content likely to impersonate or misrepresent identity or affiliation.
      • Misleading attribution to us when not accurate.
      • Advocacy, promotion, or facilitation of any unlawful acts, such as copyright infringement or computer misuse.

Zero Tolerance Spam Policy

  • Strict Policy:
    • We enforce a strict policy against unsolicited email, bulk emailing, and spam. We retain the right to terminate the account of any user found sending spam, with or without notice.
  • Prohibited Hosting:
    • Websites advertised as spam are prohibited from being hosted on our servers. This restriction encompasses spam transmitted via fax, phone, postal mail, email, instant messaging, or newsgroups. Any user account resulting in our IP space being blacklisted will face immediate suspension and/or termination.
  • Compliance Enforcement:
    • Broccolihost retains the right to enforce necessary changes or disable any website, account, database, or component not in compliance with our anti-spam policy.
  • Fee and Charges:
    • Broccolihost reserves the right to levy a clean-up fee or any charges incurred for blacklist removal, at our sole discretion, against the account holder responsible for sending unsolicited email.

Suspension and Termination

  • Policy Breach Assessment:
    • We reserve the right to determine, at our discretion, whether a breach of this acceptable use policy has occurred through your use of the Hosting Services. Upon detecting a breach, we may take appropriate action.
  • Breach Consequences:
    • Failure to comply with this acceptable use policy constitutes a material breach of our terms and conditions, permitting your use of the Hosting Services. Consequently, we may initiate any or all of the following actions:
      • Immediate, temporary, or permanent withdrawal of your right to use the Hosting Services.
      • Immediate, temporary, or permanent removal of any Material (as defined above) uploaded to our servers.
      • Issuance of a warning to you.
      • Commencement of legal proceedings against you for the reimbursement of all costs incurred on an indemnity basis, including reasonable administrative and legal costs, resulting from the breach.
      • Pursuit of further legal action against you.
      • Disclosure of information to law enforcement authorities, if deemed reasonably necessary.

We reserve the right to amend this acceptable use policy at any time by updating this page. It is your responsibility to periodically review this page to stay informed of any modifications. As any revisions made here are legally binding, your continued use implies acceptance of these changes.
